  1. Terms of Service.

These Terms of Service (“Terms”) govern your access to and use of the services, including our various websites, SMS, APIs, email notifications, newsletters, applications, buttons, and widgets, (the “Services” or “FamilyTravelHQ”), and any information, text, graphics, photos or other materials uploaded, downloaded or appearing on the Services (collectively referred to as “Content”). Your access to and use of the Services are conditioned on your acceptance of and compliance with these Terms. By accessing or using the Services you agree to be bound by these Terms.

  1. Amendments:

The Services that FamilyTravelHQ provides are always evolving and the form and nature of the Services that FamilyTravelHQ provides may change from time to time without prior notice to you. In addition, FamilyTravelHQ may stop (permanently or temporarily) providing the Services (or any features within the Services) to you or to users generally without prior notice to you. Please do check these T&Cs regularly. Should you continue to use the Services, you will be deemed to have accepted any revised terms and conditions. From time to time we may choose to supplement these T&Cs with additional terms and conditions (“Additional T&Cs”) – for example in connecting with a competition we are running – these will be clearly displayed within the content of the text to which the revised T&Cs apply. We also retain the right to create limits on use and storage at our sole discretion at any time without prior notice to you.

  1. Registration:

Although parts of FamilyTravelHQ can be accessed without the need to register with us, you will need to sign up in order to access certain parts of the Site. We may also use your details to send out the occasional Newsletter. When you register, you are confirming that you are over 18 years of age, or, if you are a minor over 13 years of age, that you have obtained parental consent to use that part of the Service you are registering for. Once you have signed up, you confirm that any information you provide us with from time to time is true, accurate and complete. We reserve the right to terminate your account without notice should you fail to comply with this statement. You are responsible for your use of the Services, for any Content you post to the Services and for any consequences thereof. The Content you submit, post, or display will be able to be viewed by other users of the Services and through third party services and websites (in your profile you can choose what personal information is visible for others). You should only provide Content that you are comfortable sharing with others under these Terms.

  1. Passwords:

When you sign up it will be necessary for you to create a password for your account. You are responsible for keeping this password confidential and for any activities or actions under your password secure. We encourage you to use “strong” passwords (passwords that use a combination of upper and lower case letters, numbers and symbols) with your account. FamilyTravelHQ cannot and will not be liable for any loss or damage arising from your failure to comply with the above. If it important that you contact us immediately should you suspect that a third party is accessing your account. Should you forget your password, please follow the instructions ‘Forgot your password?’ in your login box.

  1. Newsletters:

When you register with FamilyTravelHQ you may select to receive our Newsletter. If you do not wish to receive these, you may unsubscribe at any time by following the ‘unsubscribe’ link at the bottom of the newsletter.

  1. Content on the Services:

The goal of FamilyTravelHQ is to collate the best Family Travel writing on the web. We encourage you to submit your favourite hotel reviews, travel tips, destination guides and more on the Service (and any platforms connected to the Service including Facebook, Twitter, Pinterest and Instagram). All content generated by those using the Services (“User Content”), and this comprises any material (including without limitation text, images, location information, comments, data, text, graphics, audio material, video material and audio-visual material) that you submit, upload, create, distribute, email or post to FamilyTravelHQ via the Service, is the sole responsibility of the person who originated such Content. You represent and warrant that you own or have the necessary licenses, rights, consents and permissions to your User Content (and all content included therein). FamilyTravelHQ may not monitor or control the Content posted via the Services and, we cannot take responsibility for such Content. Any use or reliance on any Content or materials posted via the Services or obtained by you through the Services is at your own risk. By submitting User Content to FamilyTravelHQ via the Service (and any platforms connected to the Service including Facebook, Twitter, Pinterest and Instagram) you grant FamilyTravelHQ and our associated third parties a worldwide, irrevocable, non-exclusive, royalty-free, perpetual, transferable and fully sub-licensable right to:

  1. use, reproduce, adapt, modify, create derivative works from, publish, translate and distribute User Content in any existing or future media, advertisements, marketing materials or platforms (now known or hereafter devised), applications or any other medium as part of the Service; and
  2. use the name connected with your User Content in the form of an accreditation at our discretion. You further grant FamilyTravelHQ the right to pursue at law any person or entity that violates your or FamilyTravelHQ’s rights in User Content by a breach of these T&C’s. You acknowledge and agree that User Content is non-confidential and non-proprietary. You also grant to us the right to sub-license these rights, and the right to bring an action for infringement of these rights.
  3. This license ends when you delete your account and User Content (see clause 7).
  4. You warrant and represent that the User Content you submit to FamilyTravelHQ is not illegal or unlawful, does not infringe any third party’s legal rights, and is not capable of giving rise to legal action whether against you or FamilyTravelHQ or a third party (in each case under any applicable law). You warrant to FamilyTravelHQ that your User Content is appropriate, civil, tasteful and accord with generally accepted standards of etiquette and behaviour on the internet. User Content must not:
    • be libellous or maliciously false;
    • be obscene or indecent;
    • infringe any copyright, moral right, database right, trade mark right, design right, right in passing off, or other intellectual property right;
    • infringe any right of confidence, right of privacy, or right under data protection legislation;
    • constitute negligent advice or contain any negligent statement;
    • constitute an incitement to commit a crime;
    • be in contempt of any court, or in breach of any court order;
    • be in breach of racial or religious hatred or discrimination legislation;
    • be blasphemous;
    • be in breach of official secrets legislation;
    • be in breach of any contractual obligation owed to any person;
    • depict violence in any form
    • be pornographic [or sexually explicit];
    • be untrue, false, inaccurate or misleading;
    • consist of or contain any instructions, advice or other information which may be acted upon and could, if acted upon, cause illness, injury or death, or any other loss or damage;
    • constitute spam;
    • be offensive, deceptive, threatening, abusive, harassing, or menacing, hateful, discriminatory or inflammatory;
    • cause annoyance, inconvenience or needless anxiety to any person;
    • link to any third party site or page consisting of or containing material that would, were it posted on the Services, breach the provisions of these T&C’s; or
    • be or have been the subject of any threatened or actual legal proceedings or other similar complaint.

We reserve the right to edit or remove, without prior notice, any User Content submitted to the Services, stored on our servers, or hosted or published upon the Site for any reason, and to terminate or refuse your access to the Site and Services for any reason.

FamilyTravelHQ aims to promote the best in family travel writing. We have a minimum requirement in terms of photography and wording to ensure there is uniformity across the site. We reserve the right to edit or remove, without prior notice, any User Content that we do not believe conforms to the site. For more information on content guidelines, please see our FAQ.

We do not endorse, support, represent or guarantee the completeness, truthfulness, accuracy, or reliability of any Content or communications posted via the Services or endorse any opinions expressed via the Services. You understand that by using the Services, you may be exposed to Content that you might consider offensive, harmful, inaccurate or otherwise inappropriate, or in some cases, postings that have been mislabeled or are otherwise deceptive.

Under no circumstances will FamilyTravelHQ be liable in any way for any Content, including, but not limited to, any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Services or broadcast elsewhere. No information or advice (written or oral) shall imply a warranty by FamilyTravelHQ unless specifically made within these T&C’s or imposed by law. You acknowledge that your use of the Site and Newsletters is undertaken at your own risk.

We may, but have no obligation to, remove content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, defamatory, obscene, invades the privacy of others, or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

We reserve the right to remove any content that we feel may include personally identifiable documentation or scans of documents issued by banks or governments (social security numbers, passport numbers, credit card numbers, drivers licenses, etc.).

In addition, you may not use FamilyTravelHQ for any illegal or unauthorised purpose. You are solely responsible for any activity that occurs under your screen name as well as your conduct and any data, text, information, screen names, graphics, photos, profiles, audio and video clips, links (“content”) that you submit, post and display on FamilyTravelHQ. You may not modify, adapt or hack FamilyTravelHQ or modify another website so as to falsely imply that it is associated with FamilyTravelHQ. You must not transmit any worms or viruses or any code of a destructive nature.

You must not, in the use of FamilyTravelHQ, violate any laws in your jurisdiction (including, but not limited to, copyright laws).

Violation of any of these agreements will result in the termination of your FamilyTravelHQ account.

  1. Modifying Your Personal Information:

If you are a registered user of our Services, we provide you with tools and account settings to access or modify the personal information you provided to us and associated with your account. You can also permanently delete your FamilyTravelHQ account. In that case your account will be deactivated and then deleted. When your account is deactivated, it is not viewable on FamilyTravelHQ.com. Once you share your User Content the content may persist on third party sites until it is deleted. We will make every effort to delete your content once you send us an email requesting us to do so but it is possible that some of the pins may be unintentionally missed. If there are specific pinned posts you are looking to delete then please email and let us know about them.

  1. Additional Information:

You may provide us with profile information to make public, such as a short biography, your location, your website, or a picture. You may provide information to customize your account, such as a cell phone number. We may use your contact information to send you information about our Services or to market to you. You may use your account settings to unsubscribe from notifications from FamilyTravelHQ. You may also unsubscribe by following the instructions contained within the notification or the instructions on our website. We may use your contact information to help others find your FamilyTravelHQ account, including through third-party services and client applications. You may choose to upload your address book so that we can help you find FamilyTravelHQ users you know. We may later suggest people to follow on FamilyTravelHQ based on your imported address book contacts, which you can delete from FamilyTravelHQ at any time. If you email us, we may keep your message, email address and contact information to respond to your request. If you connect your FamilyTravelHQ account to your account on another service in order to cross-post between FamilyTravelHQ and that service, the other service may send us your registration or profile information on that service and other information that you authorize. This information enables cross-posting, helps us improve the Services, and is deleted from FamilyTravelHQ within a few weeks of your disconnecting from FamilyTravelHQ your account on the other service. Providing the additional information described in this section is entirely optional.

  1. Creating Pins: 

The key functionality of FamilyTravelHQ is leaving pins, information and/or images for your friends or the public to find. As you create these pins you should be mindful of your privacy. You may not want to leave a pin publicly that identifies where you live. Additionally, be mindful of the privacy of others when creating pins. For more information on creating Pins, please see our FAQ.

  1. Pins, Following and other Public Information:

Our Services are primarily designed to help you share information with the world. Most of the information you provide us is information you are asking us to make public. This includes not only the pins you share and the metadata provided with posts, such as when you submit, but also the lists you create, the people and keywords you follow, the posts you mark as favorites or share, and many other bits of information that result from your use of the Services. Our default is almost always to make the information you provide public for as long as you do not delete it from FamilyTravelHQ, however there is the option to make your information more private. Your public information is broadly and instantly disseminated. For instance, your public user profile information and public posts may be searchable by search engines and are immediately delivered our APIs to a wide range of users and services. When you share information or content like photos, videos, and links via the Services, you should think carefully about what you are making public.

  1. Copyright Policy 

FamilyTravelHQ is compliant with notice and takedown of infringing material under the DMCA. Upon receipt of a complete and vetted notice, FamilyTravelHQ will take down content in a timely manner and send notification to the FamilyTravelHQ member who posted the allegedly infringing material.

A complete notice must include all of the following elements:

  • name, email address, postal address and telephone number of the person notifying
  • description that would allow for identification of infringing material on FamilyTravelHQ
  • URL on FamilyTravelHQ of the infringing material
  • a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law
  • a statement by you, made under penalty of perjury, that the above information in your Notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner’s behalf
  • physical or electronic signature.

  1. Intellectual Property:

all copyright, trade marks (registered or unregistered), design rights, database rights and other intellectual property rights of any nature arising from the material, content and information on the Site and within the Newsletters, including the design, layout and organisation, are owned or licensed by FamilyTravelHQ. FamilyTravelHQ grants express permission for you to access, download, or print material from the Site and Newsletters for your personal, non-commercial use only, provided that you do not amend the material in any way. Except where expressly stated, none of the material on the Site or within the Newsletters, may be copied, reproduced, distributed, republished, downloaded, displayed, posted, or transmitted in any form by any means, including but not limited to, electronic, mechanical, photocopying, recording or otherwise without the prior written permission of FamilyTravelHQ.

  1. Advertisements:

The Services may include advertisements, which may be targeted to the Content or information on the Services, queries made through the Services, or other information. The types and extent of advertising by FamilyTravelHQ on the Services are subject to change. In consideration for FamilyTravelHQ granting you access to and use of the Services, you agree that FamilyTravelHQ and its third party providers and partners may place such advertising on the Services or in connection with the display of Content or information from the Services whether submitted by you or others.

  1. Third Party Sites:

FamilyTravelHQ uses a variety of third-party services to help provide our Services, such as hosting our blogs, and to help us understand the use of our Services, such as Google Analytics. These third-party service providers may collect information sent by your browser as part of a web page request, such as cookies or your IP address. Third-party ad partners may share information with us, like a browser cookie ID or cryptographic hash of a common account identifier (such as an email address). We make no representations as to the quality, suitability, functionality or legality of any such sites to which we may provide links, or of any of the goods or services available from such sites. All matters concerning any goods and services that you purchase from a third party site, including without limitation all contract terms, are solely between you and the owner of that site and FamilyTravelHQ will not be liable for any costs or damages to you or any third party arising directly or indirectly out of any third party website. You hereby agree to waive any claim you might have against FamilyTravelHQ with respect to any such sites.

  1. Disclaimer of Warranties: 

FamilyTravelHQ is providing the Service on an ‘as is’ basis and makes no representations or warranties of any kind with respect to the Service or its content and disclaims all such representations and warranties. You understand the FamilyTravelHQ cannot guarantee the accuracy or completeness of the information provided on the Site and within the Newsletters. We are not liable for any errors, emissions or results obtained from utilising any of this information. Although we provide an information service for the benefit of you the general public, this information is provided on the basis that neither FamilyTravelHQ or any of its employees, contractors, consultants or members are engaged in providing any medical, counselling, legal or any other professional advice or service and therefore cannot be relied upon FamilyTravelHQ advise you to always seek professional advice for any problem or situation with which you require assistance. FamilyTravelHQ shall not be responsible for any loss or damage caused directly or indirectly by the information referenced or contained on either the Site or the Newsletters. No information or advice (written or oral) shall imply a warranty by FamilyTravelHQ unless specifically made within these T&C’s or imposed by law. You acknowledge that your use of the Site and Newsletters is undertaken at your own risk.

  1. Limitation of Liability:

Except as required by law, neither FamilyTravelHQ nor any of its employees, contractors or consultants are liable for loss or damage arising out of or in connection with your use of the Site, the Newsletters or any information contained within them. This is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss of or damage to property and claims of third parties.

  1. Termination and Remedies for Breach of these Terms: 

FamilyTravelHQ will be entitled to restrict, suspend or terminate your membership and/or deny you access to the Site and/or the Newsletters or take such other action as we deem appropriate if we determine, in our sole discretion, that you are in breach of any of the T&C’s or that your use of the Site and/or the Newsletters is inappropriate or otherwise unacceptable. The restriction, suspension or termination of our service pursuant to this section will be without prejudice to any rights which FamilyTravelHQ may have against you in respect of your breach of these T&C’s. We shall be entitled to disclose your user identity and details if required or requested to by the courts or any other law enforcement authority and/or agency or in such other circumstance as specified in our Privacy Policy.

  1. Indemnity:

You agree to indemnify and hold each of FamilyTravelHQ, its employees, contractors or consultants harmless from any claim or demand, including reasonable solicitors fees, made by any third party due to or arising out of your use of the Site and/or the Newsletters, the violation of these T&C’s by you, or the infringement by you, or any other subscriber of your account, or of any intellectual property or other right of any other person or entity.

  1. Applicable Law:

These T&C’s shall be governed by and construed in accordance with the laws of England and any dispute shall be subject to the exclusive jurisdiction of the English courts.

  1. Miscellaneous:

Any failure or delay by us to enforce strict performance on you of any of the T&C’s or to exercise any right under the T&C’s will not be construed as a waiver of our rights. These T&C’s, any Additional T&C’s and the Privacy Policy constitute the entire understanding between you and us as to your use of the Site and/or the Newsletters and supersede all prior agreements and understandings. FamilyTravelHQ reserves the right to assign its rights and obligations under these T&C’s (and any Additional T&C’s) to any third party without your consent. Upon such assignment TiYK shall be relived of any further obligation that arises under these T&C’s (and any Additional T&C’s).

  1. Competitions:

competitions run by FamilyTravelHQ from time to time (“the Competition”) are open to residents of the UK aged 18 years or over except employees of FamilyTravelHQ, their families, agents or anyone else professionally associated with the Competition.

  1. Privacy:

We take your privacy very seriously. This Privacy Policy describes how we treat the information we collect when you visit and participate within the FamilyTravelHQ. Any information that you provide to FamilyTravelHQ is subject to our privacy policy, which governs our collection and use of your information. You understand that through your use of the Services you consent to the collection and use (as set forth in the Privacy Policy) of this information, including the transfer of this information to the United States, United Kingdom and/or other countries for storage, processing and use by FamilyTravelHQ. As part of providing you the Services, we may need to provide you with certain communications, such as service announcements and administrative messages. These communications are considered part of the Services and your FamilyTravelHQ account, which you may not be able to opt-out from receiving.

Information Collection and Use: We collect and use your information below to provide our Services and to measure and improve them over time.

Information Collected Upon Registration: When you create an account, we require an email address (we may send you an email to verify) and username. You may also elect to add a personal picture that represents you within the site and add your real name. Some of this information will be visible to the public, but your email address will remain private. You may modify any of your information at any time via your member’s page.

Information Sharing and Disclosure: FamilyTravelHQ aims to provide work opportunities to family travel bloggers looking to collaborate with PRs, brands and DMOs. To this end, your information may be shared with PR companies, brands and DMOs. If you do not wish to share this information, please notify us via email.

How your information is stored: All non-personally-identifying information, potentially personally-identifying and personally identifying-information described above is stored on restricted database servers.

Cookies: Like many websites, we use cookies and similar technologies to collect additional website usage data and to improve our Services, but we do not require cookies for many parts of our Services. A cookie is a small data file that is transferred to your computer’s hard disk. FamilyTravelHQ may use both session cookies and persistent cookies to better understand how you interact with our Services, to monitor aggregate usage by our users and web traffic routing on our Services, and to customize and improve our Services. Most Internet browsers automatically accept cookies. You can instruct your browser, by changing its settings, to stop accepting cookies or to prompt you before accepting a cookie from the websites you visit. However, some Services may not function properly if you disable cookies.

Changes to our Privacy Policy: Although most changes are likely to be minor, we may change our Privacy Policy from time to time, and at our sole discretion. If we do then you will be notified by posting the amended policy on the website or by emailing you of the nature of the modifications along with a link to the modified document so that you can review it. In all cases, use of information we collect now is subject to the Privacy Policy in effect at the time such information is collected.
